Havendo v\u00e1rios propriet\u00e1rios de um mesmo bem, esses se tornam cond\u00f4minos e t\u00eam direitos e obriga\u00e7\u00f5es proporcionais \u00e0 sua fra\u00e7\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>O que acontece se um dos herdeiros n\u00e3o quiser vender?<\/strong><\/h2>\n\n\n\n<p>Querendo um deles realizar a venda, mas os demais discordarem, dever\u00e1 ele primeiramente oferecer sua parte aos demais propriet\u00e1rios, nas mesmas condi\u00e7\u00f5es de mercado que venderia a terceiro.<\/p>\n\n\n\n<p>N\u00e3o havendo interesse de nenhum dos outros herdeiros, \u00e9 poss\u00edvel vender sua parte para um terceiro ou, n\u00e3o havendo interessados em comprar apenas a fra\u00e7\u00e3o,&nbsp;ingressar com uma a\u00e7\u00e3o de dissolu\u00e7\u00e3o de condom\u00ednio&nbsp;para, por meio de uma a\u00e7\u00e3o judicial, obrigar que todos os herdeiros vendam suas partes, comercializando, desta forma, o im\u00f3vel como um todo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Existe a possibilidade de um herdeiro impedir a venda?<\/strong><\/h2>\n\n\n\n<p>Existe uma hip\u00f3tese estabelecida por lei que impede a venda. A Lei estabelece que se o bem deixado for um \u00fanico im\u00f3vel e que sirva como resid\u00eancia do casal, o c\u00f4njuge sobrevivente possui direito real de habita\u00e7\u00e3o.
